My Child Is on a Section 504 Plan

The manifestation team determined that my child's behavior was:

a manifestation of his or her disability and the behavior did not involved drugs* or alcohol, weapons* or serious bodily injury*.

Response:

Your child cannot be disciplined further for this incident. The school must return your child to his or her current educational placement unless you and the school agree to a change of placement*. In the case of termination of bus services, the school must reinstate bus services to and from your child’s educational placement unless you and the school agree to alternative transportation.

If the school district has not already done so, it should conduct a Functional Behavioral Assessment (FBA)* and implement a Behavioral Intervention Plan (BIP)* for your child. If a BIP has already been developed, the Section 504 team should review that plan and modify it, as necessary, to address the behavior so that it is less likely to happen again. If a change of placement is being considered, Section 504 requires that an evaluation take place before a change in placement.
